Is it a crime for a 13 year old girl and a 15 year old boy to be having sex? Can the boy be punished? Are there any implications or consequences for the parents for permitting it?

The short answer is that there are many ways the teen and parent can get in trouble for this. Crimes include the obvious sex offenses, as well as Endangering the Welfare of a Minor. There is exposure to the full resources of the juvenile court for dependency and child neglect and/or abuse jurisdiction. Our advice is don’t facilitate sexual relations with a 13-year old. It’s just not worth the criminal exposure.
